Summary:
|
JVRL-220, LLC ("Property Owner") is in the process of developing approximately 511 dwelling units on property it owns in the City of Perris within the boundaries of the Eastern Municipal Water District ("EMWD") and the District ("Project"). On May 20, 2015, the District and the Property Owner Entered into a School District Facilities Funding and Mitigation Agreement ("Mitigation Agreement") in which Property Owner agreed to make certain payments for improvements to mitigate the effects of the Project on the District ("Mitigation Payments").
On November 1, 2017, EMWD formed Community Facilities District No. 2017-77 ("CFD") to finance improvement areas in the CFD. Subsequent to the formation of the CFD and pursuant to the Property Owner's request, EMWD is in the process of amending the CFD to allow for the financing of school improvements which are part of the Property Owner's obligations to the District under the Mitigation Agreement. As part of the amendment process, the parties wish to enter into a Joint Community Facilities Agreement ("JCFA").
EMWD, which has the responsibility for the formation and administration of the CFD, has concurred with Property Owner's request, and if the District concurs, adoption of Resolution No. 13:18-19 will approve the JCFA between the District, EMWD, and the Property Owner.
