Summary: Should the Board of Trustees authorize a local bond measure to be placed on the November 2018 ballot, the Perris High School Completion Phase is one of the priority improvement projects that would be funded through this bond measure. The Perris High School Completion Phase will involve many different challenges, such as construction logistics coordination, site infrastructure upgrades during school hours, and very reduced area available for construction staging. For these reasons, the District would like to select a Construction Manager to perform preconstruction services to ensure the project complexities are addressed and so that construction can begin as soon as possible, should the bond be successful. The District seeks to construct the Perris High School Completion Phase pursuant to a lease-leaseback project delivery method. As a result of the project complexities and for the ability to establish a pre-negotiated Guaranteed Maximum Price (GMP), District staff believes the use of Lease-Leaseback (LLB) delivery method is in the best interest of the District and the Project. LLB will:

(i) Allow the District (by means of “pre-construction services” agreements that are entered into prior to entering into the associated LLB agreements) to integrate contractors into the design process to facilitate constructability review, coordination and more certain pricing

(ii) Better facilitate completion of the District’s facilities projects within the scheduled amounts of time and within established budgets

(iii) Allow, if desired, outreach efforts to use qualified local subcontractors

(iv) Reduce the potential for disputes and litigation with contractors and subcontractors.

Education Code section 17406 requires school districts utilizing this project delivery method to select its lease-leaseback contractor using a "best value" competitive procurement process. Pursuant to this process, school districts must evaluate responsive firms based on objective criteria, assign a best value score to each proposal, and select the contractor that represents the highest best value score based on price and qualifications.

In 2017, the Board of Trustees adopted AR 3311.2 summarizing the District's required "best value" competitive procurement process for lease-leaseback projects. In compliance with both Education Code section 17406 and District AR 3311.2, this RFP requests proposals from qualified firms and sets forth the specific criteria and methodology by which the District will evaluate proposals to select the contractor who will best fit the needs of the District.

Education Code 17604 and 17605: The Governing Board delegates the power to contract and purchase supplies, equipment and services.
Funding: There is no fiscal impact to this item.
Recommendation: It is recommended that the Board of Board of Trustees approve the issuance of the RFP for the Perris High School Completion Phase Project and direct staff to take any further action necessary to complete the transaction, including, but not limited to, making minor revisions, issuing the RFP, pre-qualifying applicants, and reviewing the responsive proposals.
