Summary: California Public Contract Code section 20118 provides that if there is an existing contract between a vendor and a public agency, then the governing Board of any school district may authorize the purchase of personal property directly from the vendor, without advertising for bids, after the District’s Governing Board makes a finding that using the Master Intergovernmental Cooperative Purchasing Agreement is in the best interest of the school district and that the school district will make payment under the same terms that are available to the public agency.

Maricopa County, as the lead agency for U.S. Communities Government Purchasing Alliance, conducted a competitive bidding process for the purchase of various maintenance and industrial supplies. Perris Union High School District’s participation in the purchasing alliance over the years allows us to utilize various Master Agreements entered into through the U.S. Communities Government Purchasing Alliance program. The District wishes to purchase maintenance and industrial supplies for use throughout the district on an as-needed basis. Staff recommends that the Board find that purchasing the needed materials and supplies from Home Depot under the same terms available under the U.S. Communities Master Agreement is in the District’s best interest.
Funding: The cost for this item is included in the 2019-20 operating budget funded through the Maintenance Fund, not the General Fund.
Recommendation: It is recommended that the Board of Trustees approve the use of U.S. Communities Master Agreement with Home Depot for maintenance, repair, operating supplies, industrial supplies, and related products and services.
