Summary: In November 2012, California voters approved the Clean Energy Jobs Act (Proposition 39): Clean Energy and Energy Efficiency Funding Initiative Statute. The measure dedicates revenues for five years to clean and efficient energy projects. Through the use of the Request for Qualifications (RFQ) process, OpTerra Energy Solution (now ENGIE Services U.S. Incorporated) was selected to to develop the District's Proposition 39 Energy Expenditure Plan, which was approved by the Perris Union High School District's Board of Trustees on March 18, 2015. The California Military Institute (CMI) Campus was included in the March 18, 2015 Energy Expenditure Plan but was not included in the District energy upgrade project due to the funding for this campus being a separate allocation from the California Department of Energy. Now that the entire allocation of funds for CMI are available, the District's Facilities Department would like to move forward with the CMI Energy Project and its own Energy Expenditure Plan. ENGIE Services U.S. has conducted the required energy audits and prepared an expenditure plan for CMI which has identified viable energy conservation measures. These measures include LED lighting upgrades throughout CMI. Based on the information gathered through the District's Prop. 39 RFQ and the selection of ENGIE Services U.S. Incorporated by the Board of Trustees to develop the CMI Energy Expenditure Plan, the Facilities Team would like to extend the contract for the implementation of the CMI energy expenditure plan to ENGIE Services U.S. Incorporated.

The cost of the CMI Prop. 39 Energy Expenditure Plan is $361,874 which will be funded through Prop. 39 funds.

Education Code 17604 and 17605: The Governing Board delegates the power to contract and purchase supplies, equipment, and services.

Government Code 4217.10 through 4217.18: The District may enter into energy service contracts to provide energy conservation services.
Funding: The cost for this item is funded through Prop 39 (California Clean Energy Jobs Act), not the General Fund.
Recommendation: It is recommended that the Board of Trustees approve the Energy Services Contract with ENGIE Services U.S. Incorporated, formerly, Opterra Energy Services, to execute the California Military Institute’s Proposition 39 Energy Expenditure Plan.
