Summary: On May 16, 2012 the District Board of Trustees approved a Lease Agreement with Mobile Modular Management Corporation for the lease of one classroom portable at Pinacate Middle School in order to accommodate student enrollment. Additionally, on March 19, 2014, the Board of Trustees approved Lease Agreements for nine classroom portables and one restroom portable to be used as interim housing during the Phase 2 and PACE Facilities Projects on the Perris High campus. Recently Mobile Modular notified the District of changes to the monthly lease pricing and terms for these portables at each site.

These changes are as follows for Pinacate Middle School:

24x40 classroom portable - $275 to $531 per month, 24 month lease extension from June 27, 2017 through June 16, 2019.

These changes are as follows for Perris High School:

24x40 classroom portables - $425 to $539 per month, 1 year lease extension from July 10, 2017 through July 14, 2018.
36x40 classroom portables - $1,065 to $1,348 per month, 1 year lease extension from July 10, 2017 through July 14, 2018.
48x40 classroom portables - $1,325 to $1,723 per month, 1 year lease extension from July 10, 2017 through July 14, 2018.
12x40 restroom building - $1,419 to $1,561 per month, 1 year lease extension from July 10, 2017 through July 14, 2018.

This item is being taken to the Board as a ratification due to the untimely receipt of the Addenda from Mobile Modular.

Education Code Section 17450 permits a school district to lease or lease-purchase equipment or service systems, including but not limited to, all items defined as equipment in the California School Accounting Manual, with any persons, firm, corporation or public agency. Additionally, if there is an existing contract between a public agency and a vendor for the lease or purchase of the personal property, Public Contract Code Section 20118 allows school districts to lease or purchase the personal property directly from the vendor by contract, lease, requisition, or purchase order and make payments directly to the vendor under the same terms that are available to the public agency under the contract.
Funding: The cost for this item is included in the 2017-18 and 2018-19 operating budgets funded through the various Facilities Funds, not the General Fund.
Recommendation: It is recommended that the Board of Trustees approve the contract renewals and Addenda with Mobile Modular Management Corporation for the continued lease of portables at Perris High School and Pinacate Middle School.
