Summary: The District previously identified the need to replace the existing loudspeaker and paging system at Paloma Valley High School.

Public Contract Code section 20118.2 permits school districts to engage in a competitive negotiation process to procure computers, software, telecommunications equipment, microwave equipment, and other related electronic equipment and apparatus. When a school district finds that it is in the public’s interest to consider factors other than price, the District can issue a Request for Proposals (“RFP”) to include factors such as price, vendor financing, performance reliability, standardization, life-cycle costs, delivery timetables, support logistics, the broadest possible range of competing products and materials available, fitness of purchase, manufacturer’s warranties, and similar factors. Public Contract Code section 20118.2 provides that, following the competitive negotiation process, if an award is not made to the bidder whose proposal contains the lowest price, the school district shall make a finding setting forth the basis for the award.

At its regularly scheduled May 15, 2019 Board Meeting, the District passed Resolution No. 30:18-19, “Resolution Authorizing Procurement for IP Paging and Speaker Equipment Through Public Code Section 20118.2” authorizing the Superintendent, or designee, to engage in a competitive negotiation process in compliance with Public Contract Code section 20118.2 for the procurement and implementation of new IP paging speaker equipment in connection with technology updates being conducted at Paloma Valley High School, and directed the Superintendent, or designee, to take such further actions as may be necessary to carry out said procurement and implementation of the Project. In May 2019, the District conducted an RFP to review the scope and specifications of Speaker Equipment replacement need for the Project. Upon evaluation of the proposals AMS.NET (“AMS”) was determined to have offered the best value for the Project. The total cost for the Project is $172,577.73, which includes the Speaker Equipment.

Due to the highly specialized and unique nature of campus-wide loudspeaker and paging systems, it is recommended that the Board of Trustees adopt Resolution No. 40:18-19 to make a finding consistent with Public Contract Code section 20118.2 that, considering all factors evaluated by the District during the RFP process, including the cost of equipment, demonstration of a creative and cost-effective design, experience and ability to provide the necessary services, ability to satisfy project goals, and sufficiency of customer service and support teams, AMS meets the Project requirements, satisfies the District’s RFP, would provide the District with the most advantageous product as sought under the RFP, and the District should therefore award the contract for purchase of the Speaker Equipment to AMS.

This project was approved by the Board of Trustees on November 14, 2018 with the Agreement for Engineering Services, and again on May 15, 2019 with Resolution No. 30:18-19. As such, this agreement has been awarded to AMS.NET and is requested for ratification due to the lead time on the specified equipment.
Funding: The cost for this item will be included in the 2019-20 operating budget funded through the General Fund, One-Time Funds.
Recommendation: It is recommended that the Board of Trustees adopt Resolution No. 40:18-19 approving the purchase of IP paging and speaker equipment and the ratification of award of RFP# 052119 to AMS.NET.
