Summary: The Board of Trustees (“Board”) of the Perris Union High School District (“District”) acting as the legislative body of Community Facilities District No. 92-1, previously initiated proceedings, held a public hearing, conducted an election, and received a favorable vote from the qualified electors relating to the levy of a special tax in a community facilities district (“CFD No. 92-1”), all as authorized pursuant to the terms and provisions of the Mello-Roos Community Facilities Act of 1982.

On June 3, 2019 the Board acting as the legislative body of CFD No. 92-1, approved the Amended and Restated Mitigation Agreement between PUHSD and Global Investment Pool LLC (“Mitigation Agreement”). The Mitigation Agreement required that the District record a Notice of Cancellation of Special Tax Lien (“Cancellation”) for designated parcels, within thirty (30) days of notice of the fulfillment of certain conditions specified in the Mitigation Agreement. On April 17, 2020, the District received notification that all three conditions were fully satisfied and fulfilled and proceeded to record the Cancellation in the Official Records of the County of Riverside.

Staff is requesting that the Board, acting as the legislative body of CFD No. 92-1, approve the attached Resolution No. 40:19-20 ratifying the recordation of the Cancellation.
Funding: No fiscal impact.
Recommendation: It is recommended that the Board of Trustees ratify Resolution No. 40:19-20 - Resolution of the Board of Trustees of the Perris Union High School District, Acting as the Legislative Body of the Community Facilities District No. 92-1, Ratifying Cancellation of Notice of Special Tax Lien for Designated Parcels.
