Summary: The District and the City of Perris entered into a Joint Facility Use Agreement dated October 15, 2014, for the planning, use, operation and/or maintenance of specified public facilities throughout the City of Perris. Amendment No. 1, effective September 13, 2016, was approved to allow the California Military Institute (CMI) the ability to utilize the Bob Glass gymnasium and the City to utilize the Perris High School gymnasium, each at no cost to the District or the City. Amendment No. 2, effective January 1, 2017, was approved to allow the City to also utilize the Pinacate Middle School gymnasium.

The City now desires to utilize the Perris High School pool to operate a summer community swim program. Amendment No. 3 would allow for this use, as well as modify certain terms of the Agreement, primarily insurance and indemnification, to accommodate the best interests of both parties and to ensure compliance with applicable state and federal laws, District policies, procedures, and applicable regulations.

The District will charge a a flat rate of $1,700 for use of the Perris High School pool for the Summer of 2018 which will cover the increased use of chemicals and cleaning. Summer use in subsequent years would include fees to cover any increased costs for the District and would be mutually agreed upon by the City and the District. All other operational costs to operate the summer community swim program, including lifeguards, will be a cost of the City. Should any use of the pool occur outside of regular operating hours, the City will pay all costs in accordance with the previously approved Agreement.
Funding: The budget will be adjusted to reflect this revenue.
Recommendation: It is recommended that the Board of Trustees approve Amendment No. 3 to the Joint Facility Use Agreement between the District and the City of Perris.
