Summary:

Over the last several years the litigation trend for workers compensation claims has been moving into the Fair Employment and Housing Act EHA (State Disability) and Americans with Disabilities Act (Federal Disability) arena. It is no longer enough to do everything “right” on the workers compensation claim to protect the District from a civil claim related to disability discrimination and not engaging in the interactive process.
Subsequently, the District recently started working with Shaw HR Consulting, Incorporated to assist with the disability interactive process coordination and facilitation related to a single litigated workers compensation claim. The District also worked with Shaw HR Consulting, Incorporated to help develop customized Essential Function Job Analyses (EFJA) for additional positions.
It was not anticipated that the services would exceed $10,000. However, it has become evident that additional assistance is needed. This additional assistance will provide District staff with the opportunity to participate in the interactive process and potentially coordinate and facilitate the disability interactive process, going forward with best practices and procedures.
The total cost of services will be an amount not-to-exceed $35,000. The term for this Agreement will be from March 15, 2017 through June 30, 2017.
Education Code 17604 and 17605: The Governing Board delegates the power to contract and purchase supplies, equipment and services.

The cost for this item is included in the 2016-17 operating budget funded through Safety Credits, not the General Fund.
