Summary: On November 6, 2018, the voters within the Perris Union High School District (“District”) approved “Measure W” authorizing the District to issue general obligation bonds to finance certain specified District capital projects, facilities and supporting infrastructure. These proceedings were authorized, and the election conducted, pursuant to the California Constitution, the provisions of Proposition 39, related California law. Under Proposition 39 the affirmative vote requirement to authorize the bonds was 55%. Measure W gathered more than the required 55% affirmative vote (based on election results furnished by the Riverside County Registrar of Voters’ office). Under the requirements of Proposition 39 and related State law, the District is required to form a Citizens’ Oversight Committee (“Committee”) for Measure W.

Resolution No. 17:04-05, adopted by the Board of Trustees of the District (“Board”) on November 17, 2004, adopted a set of Policies and Regulations (“Original Policy”) concerning Citizens’ Oversight Committees formed by the District. Resolution No. 21:12-13, adopted by the Board on February 20, 2013, approved an amended Perris Union High School District Citizens’ Oversight Committee Policy and Regulations (the “2013 Policy”), which superseded the Original Policy.

However, in the intervening years, various best practices with regard to such Committees have changed and minor changes have been made to the related statutes. The District’s Bond Counsel (Stradling Yocca Carlson & Rauth) has recommended that the Board adopt an amended Citizens’ Oversight Committee Policy and Regulations (the “Amended Policy”) to update current best practices, take into account statutory changes made since the prior Policy and Regulations were last amended, and to provide for a single oversight committee to be charged with performing the required oversight with respect to both Measure W and the District’s Measure T authorization, approved by voters of the District on November 6, 2012. As noted, the Amended Policy has been prepared based on current State law and District Bond Counsel’s experience with Citizens’ Oversight Committees for the District and other school districts that have passed Proposition 39 bond measures.

In addition, this Resolution would establish a new Citizens’ Oversight Committee, adopt bylaws therefor providing for such single Committee to review both Measure W and Measure T expenditures, and disbanding the prior Oversight Committee.

Based on the current provisions of State law, the approval of Measure W by voters of the District and the recommendations of Bond Counsel concerning Proposition 39 Citizens’ Oversight Committees, it is recommended that the Board adopt Resolution No. 18:18-19.

Recommendation: It is recommended that the Board of Trustees approve Resolution No. 18:18-19 – Resolution of the Board of Trustees of the Perris Union High School District Amending the Policy and Regulations Relative to Citizens’ Bond Oversight Committees for General Obligation Bonds Approved Pursuant to Proposition 39, Establishing A New Independent Citizens’ Bond Oversight Committee, Approving Bylaws Therefor, and Disbanding the Prior Citizens’ Bond Oversight Committee.
